Terms of Service

Effective Date: April 8, 2026

Welcome to Kanvio, operated by Korrelated, LLC ("Korrelated," "we," "us," or "our"), a California limited liability company. These Terms of Service ("Terms") govern your use of the Kanvio mobile application ("Kanvio" or the "App") and the kanv.io website (the "Website"), collectively referred to as the "Service." By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to create a Kanvio account. Kanvio does not permit account creation by individuals under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).

If you are between 13 and 17 years of age, you represent that your parent or legal guardian has reviewed and consents to these Terms. Parents and guardians are responsible for supervising their minor child's use of the Service and may configure additional restrictions through Kanvio's parental controls.

2. Your Account

To use most features of the Service, you must create an account using Sign in with Apple or Sign in with Google. You agree to:

• Maintain only one account per person
• Provide accurate information, including your date of birth
• Keep your account credentials secure
• Accept responsibility for all activity that occurs under your account

You may delete your account at any time through the App's settings. Upon deletion, all associated data will be removed within 48 hours as described in our Privacy Policy.

3. User Content and License

Ownership: You retain ownership of the content you create and upload to Kanvio, including drawings, artwork, photos, and text descriptions ("User Content").

License to Korrelated: By placing User Content on the Service, you grant Korrelated a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, display, distribute, and reproduce your User Content solely for the purpose of operating and providing the Service. This includes displaying your content to other users at the location where you place it, showing it in feeds and search results, and enabling sharing features. This license terminates when you delete the User Content or your account, except for content that has been shared by other users or cached by external platforms prior to deletion.

Your Representations: By uploading User Content, you represent and warrant that: (a) you own the content or have all necessary rights, licenses, and permissions to grant the license above; (b) the content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party; and (c) the content complies with these Terms and all applicable laws.

Public Nature of Content: User Content you place on Kanvio is visible to other users at the location where you anchor it, unless it is within a Privacy Zone. You acknowledge and accept this as a core feature of the Service.

No Guarantee of Preservation: While we take reasonable measures to maintain the Service, we do not guarantee the indefinite preservation of User Content. AR Cloud Anchors have a maximum time-to-live of 365 days, after which content may lose its precise AR positioning.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable federal, state, local, or international law or regulation
• Post content that is illegal, defamatory, obscene, threatening, harassing, or that promotes violence or hatred against any individual or group
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Post spam, chain letters, or unsolicited commercial content
• Upload malicious code, viruses, or any material that is technologically harmful
• Attempt to circumvent content moderation, safety filters, or age restrictions
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or related systems
• Scrape, data mine, or use automated means to access the Service without our written permission
• Use the Service for commercial purposes without Korrelated's prior written consent
• Interfere with or disrupt the integrity or performance of the Service

5. Content Moderation

Kanvio uses a combination of automated systems and community reporting to maintain a safe environment:

• All images are automatically scanned for inappropriate content using AI-powered safety detection
• All text content is scanned for toxicity before posting
• Users can report content that violates these Terms or our Community Guidelines
• Content receiving multiple reports may be automatically hidden pending review

Violations are addressed through an enforcement ladder: warning, 7-day restriction, suspension, and permanent ban. We reserve the right to remove any content and suspend or terminate any account at our sole discretion for violations of these Terms.

If you believe your content was removed or your account was restricted in error, you may appeal by contacting us at contact@kanv.io.

6. Copyright Infringement and DMCA

Korrelated respects the intellectual property rights of others. If you believe that User Content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of the material you claim is infringing and its location on the Service (sufficient for us to locate it)
• Your name, address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

Send DMCA notices to: contact@kanv.io with the subject line "DMCA Takedown Request."

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material and make reasonable efforts to notify the user who posted it. Users who believe their content was removed in error may submit a counter-notification.

Repeat infringers may have their accounts terminated.

7. AR and Location Features

Kanvio enables you to place digital content anchored to real-world locations using augmented reality. When using these features, you agree to:

• Comply with all applicable laws, including trespassing laws — do not access private property or restricted areas to place or view content
• Exercise personal safety and awareness of your surroundings when using AR features
• Not place content in dangerous, illegal, or inappropriate locations
• Respect public and private property

Korrelated is not responsible for any injury, damage, or legal liability arising from your use of AR and location features. Location accuracy and AR positioning are not guaranteed and may vary based on device capabilities, GPS signal quality, and environmental conditions.

8. Challenges

Kanvio allows users to create and participate in community challenges. Challenges are subject to a review and approval process. We reserve the right to reject, modify, or remove challenges that do not comply with our guidelines. Participation in a challenge does not guarantee visibility, placement on leaderboards, or any other outcome.

9. Privacy Zones and Safety Features

Kanvio provides Privacy Zones, trusted friends lists, blocking, and other safety features as tools to help protect your privacy and safety. While we design these features to function as described, they are not a guarantee of absolute privacy or security. You are responsible for configuring and using these features according to your needs.

10. Intellectual Property

The Kanvio name, logo, and all related branding, the App's code, design, and visual elements are owned by Korrelated, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use Korrelated's or Kanvio's trademarks without our prior written permission.

User Content remains the property of the users who create it, subject to the license granted in Section 3.

11. Third-Party Services

The Service relies on third-party services including Google Cloud Platform (Firebase Authentication, Cloud Vision, Cloud Natural Language, ARCore), Amazon Web Services, and Formspree. Your use of the Service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the availability, performance, or practices of third-party services.

12. User Content Disclaimer

Kanvio is a platform for user-generated content. We do not endorse, verify, or guarantee the accuracy, completeness, or quality of any User Content posted by other users. You may encounter User Content that you find offensive, objectionable, or inaccurate. You use the Service and interact with User Content at your own risk. Korrelated is not responsible or liable for any User Content posted by users of the Service.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KORRELATED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AR POSITIONING WILL BE ACCURATE. KORRELATED DOES NOT WARRANT THAT USER CONTENT WILL BE PRESERVED INDEFINITELY.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KORRELATED, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL KORRELATED, LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100.00).

15. Indemnification

You agree to indemnify, defend, and hold harmless Korrelated, LLC and its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights (including intellectual property or privacy rights).

16. Dispute Resolution

Informal Resolution: Before filing any formal legal action, you agree to first contact us at contact@kanv.io and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, rather than in court. The arbitration shall take place in California. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Exceptions: Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

18. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, including but not limited to violations of these Terms. Upon termination, the following sections survive: Sections 3 (license grant), 6 (DMCA), 10 (intellectual property), 12 (user content disclaimer), 13 (disclaimer of warranties), 14 (limitation of liability), 15 (indemnification), 16 (dispute resolution), and 17 (governing law).

19. Changes to These Terms

We reserve the right to modify these Terms at any time. The updated version will be indicated by the "Effective Date" at the top of this page. For material changes, we will provide notice through the App (once launched). Your continued use of the Service after changes constitutes acceptance of the modified Terms.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Korrelated, LLC regarding your use of the Service and supersede all prior agreements, representations, and understandings.
